We support companies in implementing AI Management Systems (AIMS) aligned with ISO/IEC 42001, conducting AI impact assessments, and building transparency–accountability mechanisms from strategy to daily operations.
1) What does Article 41.1(b) require – and why does it matter?
Article 41.1(b) of the Digital Technology Industry Law mandates that AI operations must be transparent, accountable, explainable, and subject to human oversight.
Practical implications for businesses:
Transparency: disclose what the AI does, which data it uses, and its limits/risks.
Accountability: assign responsibility, maintain reporting & remediation processes, and keep change logs.
Explainability: provide clear logic behind outcomes, tailored for users, managers, and auditors.
Human oversight: enable review, intervention, and user appeals or complaints.
Compliance reduces legal & ethical risks, enhances market trust, and ensures compatibility with ISO/IEC 42001 (AIMS) and ISO/IEC 23894 (AI risk management).
2) What should companies do?
Governance & Oversight: establish an AI Ethics & Risk Committee, appoint a Responsible AI (RAI) Lead, and define reporting lines.
Transparency Toolkit: such as System Card, Data Sheet & Lineage, User Notice, Evaluation Summary, Change Log for each version).
Accountability & Monitoring: maintain an AI Risk Register, incident reports, complaint-handling procedures, and set explanation levels by stakeholder type.
Global Alignment: map Article 41.1(b) requirements against ISO/IEC 42001 & ISO/IEC 23894, create an audit evidence plan, and run awareness training for staff.
Conclusion
Article 41.1(b) places transparency, accountability, and explainability at the heart of AI governance. For companies, this is not only a legal duty but also a business imperative: it builds customer trust, reduces risks, and ensures sustainable AI adoption.
AI should empower, not overpower — and it is the responsibility of companies to keep it that way.
