Vietnam Proposes a Ban on Harmful AI Systems – A Significant Step Toward Safe and Responsible AI

    Vietnam has taken a major step toward establishing its first comprehensive AI legal framework, as the Ministry of Science and Technology submitted the draft Artificial Intelligence Law to the National Assembly Standing Committee on November 17. 

    A central feature of the draft is the creation of a category of “unacceptable-risk AI systems”, which will be completely banned because they can cause serious harm to human rights, national security, public order, or social safety. These include AI that impersonates humans to deceive, exploits vulnerable groups, spreads harmful deepfakes or misinformation, or is designed to support illegal activities. 

    The Government underscores the need for a legal foundation to keep pace with fast-evolving AI technologies and to ensure safe, responsible, and human-centered development while still enabling innovation and competitiveness. 

    Key directions of the proposed AI Law include: 

    • Positioning AI as critical national intelligent infrastructure. 

    • Applying risk-based regulation. 

    • Ensuring AI is safe, fair, transparent, and accountable. 

    • Protecting data sovereignty and national security. 

    • Supporting AI R&D, investment, and talent development. 

    The reviewing committee also proposes expanding prohibited uses—such as deepfake-based fraud, political manipulation, or election interference. 

    The Government will formally present the draft AI Law to the National Assembly on November 21, with full discussions scheduled for November 27.
